Website Services Agreement

1. Introduction
This Website Services Agreement (“Agreement”) governs your access to and use of the website seayoulater.tw (the “Website”) and any services provided by Seayoulater Freediving Studio (“the Studio,” “we,” “us,” or “our”). By accessing the Website or booking any service, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
If you do not agree with these terms, please discontinue use of the Website and refrain from booking our services.

By booking a Service, you represent and warrant that:
- You are at least 18 years old, or accompanied by a legal guardian.
- You are physically and medically fit to participate in water-activity–related services.
- You will comply with all safety instructions, training standards, and regulations provided by our instructors and staff.
- You will present valid certifications when required (e.g., for guided dives or advanced courses).
We reserve the right to deny participation to anyone who fails to meet eligibility requirements or poses a safety risk.

- A booking is considered confirmed only upon receipt of full payment through our designated payment system.
- Prices, availability, and schedules are subject to change without prior notice.
- You are responsible for ensuring that all information submitted during booking is accurate and complete.
- Any additional fees resulting from third-party providers (e.g., transportation, boat operators, accommodation partners) may apply and will be disclosed when relevant.
5. Cancellation, Rescheduling, and Refund Policy
- Cancellation and rescheduling policies vary by Service and may depend on weather conditions, sea states, or third-party operator policies.
- All applicable policies will be presented during booking and are deemed accepted upon payment.
- Failure to appear at the designated meeting time (“no-show”) may result in forfeiture of the full fee.
- We reserve the right to modify schedules or cancel activities if conditions are unsafe. In such cases, available remedies (rescheduling or partial refunds) will follow the specific policy communicated for the Service.
6. Assumption of Risk
Freediving, snorkeling, and ocean-related activities carry inherent risks, including but not limited to physical injury, drowning, marine life encounters, equipment malfunction, and environmental hazards.
By participating, you knowingly and voluntarily accept all associated risks and agree that the Studio, its employees, contractors, and partners shall not be held liable for injuries, losses, or damages arising from participation, except where prohibited by law.
7. Participant Responsibilities
You agree to:
- Follow all safety instructions and operational guidelines provided by instructors and staff.
- Disclose relevant medical conditions, medications, or physical limitations prior to the activity.
- Use provided equipment responsibly and return it in its original condition.
- Respect local marine environments and comply with responsible diving practices.
The Studio may remove any participant from an activity without refund if their behavior endangers themselves or others.
8. Media Rights and Usage
- Photos and videos taken during activities may be used in our marketing materials, unless you explicitly request not to be included.
- You may request removal of identifiable media content at any time, and we will make reasonable efforts to accommodate your request.
- All content on the Website, including images, text, and design, is protected by copyright and may not be reproduced without permission.
9. Personal Data Protection
- We collect, store, and process personal information solely for purposes related to booking, service delivery, and customer support.
- Personal data is handled in compliance with applicable privacy laws and our Privacy Policy.
- We do not sell or share personal information with third parties except as required to deliver Services or comply with law.
10. Dive Travel & Third-Party Services
For dive trips, charters, or travel arrangements involving third-party operators:
- Additional terms may apply and will be provided during booking.
- We act solely as an organizer or facilitator and are not responsible for third-party acts, omissions, cancellations, delays, or service quality.
- Participants must follow all rules and instructions set by third-party partners, including boat crews, transport providers, and accommodation facilities.
11. Limitation of Liability
To the fullest extent permitted by law:
- The Studio disclaims all liability for accidental injury, property loss, environmental conditions, and force majeure events.
- Our total liability, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the applicable Service.
- We shall not be liable for indirect, incidental, punitive, or consequential damages.
12. Amendments to the Agreement
We may modify or update this Agreement from time to time. The revised version will be posted on this page with an updated “Last Updated” date. Continued use of the Website or Services after changes are posted constitutes acceptance of the revised terms.
13. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of China (Taiwan).
Any disputes arising from this Agreement or the Services shall be subject to the exclusive jurisdiction of the courts of Taiwan.

Seayoulater Freediving Studio is based in Kenting, Taiwan, offering AIDA and Molchanovs freediving courses, underwater photography sessions, guided shore and boat dives, and specialized training. Our mission is to provide safe, professional, and enjoyable ocean experiences for international and local divers.
